When Technology takes the Wheel
The paper investigates whether the CMR assures the certainty of application when an autonomous vehicle supported by an A.I. (artificial intelligence) system is used to perform carriage of goods. By an autonomous vehicle with an A.I. system is understood a vehicle which is able to operate without human control and on the same level as humans. That means that the machine, namely the A.I. system, is able to perform cognitive tasks, can replace a driver and even sign contracts. By focusing on different legal qualifications of A.I. machines, the analysis is intended to test whether the framework of the CMR assures legal certainty in the light of different applications of A.I. systems (A.I. system as a vehicle’s part and equipment or A.I. agent). Starting from the historical overview on the development of A.I. that allows machines to operate autonomously and different functional and legal qualifications of A.I. machines, we look at the A.I. system through the framework of the CMR.
